This bill appropriates funding for the remainder of Fiscal Year 2015. Unfortunately, debt refinancing for the program was once again removed from the final bill this year. Additionally, thanks to NADCO’s active presence on Capitol Hill, the bill includes a provision requesting more information on SBA’s new policy on open-ended indemnities. The provision requests that SBA report to House and Senate Committees on Appropriations and Small Business in order to explain “the legal rationale for the change in interpretation of this longstanding policy and, if needed, recommend any legislative changes to address this issue.” NADCO and its attorneys maintain that this issue does not need a legislative fix but can be solved by SBA’s existing authority. NADCO will continue to advocate its stance to SBA and Capitol Hill in an effort to resolve this problem.
